Auction Terms & Conditions By bidding on an item in this sale you agree to the following terms. No "Buyer Premium" of any kind. "All Sales Final" EVERYTHING selling "As-Is" without warranty of any kind. No statement regarding condition, kind, value, or quality of a lot, whether made orally or in writing in our catalog or elsewhere, shall be construed to be an expressed or implied warranty or representation. Any such warranty is waived. Inspect before you bid. Bradeen Auctions reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. Property Inspection: Friday March 27th and Monday March 30th, 11am-2 pm at the 2 locations in Custer, SD ONLINE BIDDING OPENS Friday March 27th and begins to close at 5:00 pm MST, Monday March 30th , 2020 ---PAYMENT--- We accept cash, check, or credit card (Visa, Master Card, Discover and American Express) 3.75% swipe fee on credit card payments. Cash and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted. Wiring instructions can be provided upon request and all wire transfers will be assessed a $10 fee. All vehicle titles held up to 10 business days from close of bidding. $10 doc fee per bidder for titled vehicles. 10 day holding period and doc fee waved for cash payment made in person during scheduled settlement. South Dakota sales tax charged on all items. Except for titled vehicles. If you have a tax-exempt license, you must have a current (within the preceding 12 calendar months) South Dakota Certificate of Exemption form on file with Bradeen Auctions or sales tax will be collected. Be prepared to fill one out at checkout. If you cannot attend the settlement in person you will need to print, fill out completely, sign, & mail the following form. Mail the completed form to, Bradeen Auctions PO Box 686 Custer, SD 57730 Original signed form must be received at Bradeen Auctions office by settlement day. No refunds for tax collected if Certificate of Exemption form received after the scheduled settlement. Please plan accordingly. You must contact Bradeen Auctions by phone, email, or in person during the scheduled onsite settlement if payment is other than the credit card used for registration. You authorize Bradeen Auctions to charge your credit card if no contact has been made by the end of the scheduled settlement. Please note the buyer will also be responsible for a 3.75% credit card transaction fee, and handling/storage fees incurred by Bradeen Auctions. ---REGISTRATION--- A credit card is required for auction registration to verify the identity of our bidders and to protect the integrity of our bidder's pool. Thank you for your cooperation. If you believe you have registered but have not been asked to enter your credit card information YOU HAVE NOT FINISHED THE REGISTRATION PROCESS. The first lot you bid on will prompt you to enter your credit card information. Please bid early to ensure you are completely registered. ---SETTLEMENT & TRANSFER OF POSSESSION--- Wednesday April 1st from 10:00 am to 3:00 pm Cash and check payments accepted on settlement day during scheduled hours. After that time, only payment by credit card will be accepted. Shipping services available at buyer's risk and expense. Bradeen Auctions is not responsible for any acts or omissions in regard to handling, packing or shipping. As a successful bidder, it will be your responsibly to remove all your items by the given dates. Please plan accordingly and bring the necessary assistance and vehicles/trailers required to load and haul your items. All items must be paid in full prior to loading. You will be required to provide a copy of your paid in full receipt before you will be allowed to remove any items from the property. ---ADDITIONAL FEES & EXPENSES--- Please note that we do not charge a buyer's premium. As a result, we do charge fees for any additional services that are required. Those services include payment by credit card, handling, storage, & shipping. Buyers can avoid all additional fees by paying with cash or check in person at the scheduled onsite settlement, and removing all items. If you are unable to attend the scheduled onsite settlement the following fees will apply. 1.) 3.75% credit card swipe fee. Cash and check payments only accepted on settlement day during scheduled hours. 2.) Minimum $15 handling/storage fee per bidder. Additional handling/storage expense incurred depending on size and/or volume of items. 3.) If shipping is required. Actual cost of shipping (USPS, UPS, FedEx, etc.), packaging, and insurance (if requested) will be charged in addition to any handling and storage fees. *ADDITIONAL NOTE* Buyer must take possession of all items no later than 7 business days from the auction closing unless alternate arrangements have been made. Minimum storage and handling fees may still apply. If the buyer has not taken possession of all items by this time the property will be considered abandoned and ownership will revert back to the seller. At the discretion of Bradeen Auctions, any bidders who fail to pay in full (including additional fees), or who abandon any items may have their bidding privileges revoked. ***ONLINE AUCTION DISCLAMER*** When using our online auction services, you are making firm commitments to purchase said item(s) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Nonpaying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. You also acknowledge that the Internet may be an unreliable and error prone network. Bradeen Auctions will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Bradeen Auctions and their employees harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Bradeen Auctions retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice.
